Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Biostrips Corporation ("Biostrips", "we", "us"), the company behind the SENO brand. They cover your use of senostrips.com and any SENO products, waitlist or orders (together, the "Services"). By using the Services you accept these Terms. If you don't agree, don't use the Services.

PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION.

1. Adults 21+ only

The Services and SENO products are only for adults aged 21 or older who already use nicotine products. By using the Services, you confirm that you are 21 or older and meet the minimum legal age to buy nicotine products where you live. We may verify age at any point, including at checkout and on delivery, and may cancel any order or account we reasonably believe involves an underage person. Providing false age information is a breach of these Terms and may be unlawful.

2. Nicotine warning and product risks

WARNING: This product contains nicotine. Nicotine is an addictive chemical.

• SENO is not a smoking cessation product and is not intended to diagnose, treat, cure or prevent any disease or condition.
• We make no claim that SENO is safer than, or less harmful than, cigarettes or any other tobacco or nicotine product, or that it reduces the risk of any disease.
• SENO is not for anyone who doesn't already use nicotine, or for people who are pregnant or breastfeeding. Anyone with heart disease, high blood pressure, diabetes or another medical condition, or who takes medication, should talk to a doctor before using nicotine.
• Use only as directed on the package and keep out of reach of children and pets. If a child or pet may have swallowed a strip, call Poison Help at 1-800-222-1222. Call 911 for trouble breathing, collapse or a seizure.

You use SENO products voluntarily and at your own risk, with knowledge of the risks of nicotine use.

3. No medical advice

Content on the Services is general product information only and is not medical advice. Always seek the advice of a qualified healthcare professional with any questions about nicotine use or quitting.

4. Where SENO is available

Nicotine products are regulated differently by each state and locality. Some places restrict or ban flavored products, online sales or delivery. The Services are void where prohibited. We may refuse, limit or cancel any order to comply with law, and we don't ship to places where sale or delivery is prohibited. You are responsible for following the laws where you live.

5. Waitlist, pricing and availability

SENO is not yet on general sale. Joining the waitlist doesn't create an order, reservation or contract, and doesn't guarantee availability, launch pricing, a particular flavor or shipment to your state. Product descriptions, images, flavors, prices and launch dates may change without notice. Images are for illustration and may differ from the actual product. We're not liable for typographical errors and may correct them at any time, including after an order is placed.

6. Orders

If retail ordering opens, every order is an offer by you to buy. It is accepted only when we confirm it and verify your age. We may refuse or cancel any order, including for suspected fraud, resale, underage purchase, pricing errors or legal restrictions, and will refund any payment for a cancelled order. Purchases are for personal use only and may not be resold, except by licensed wholesale customers under our Wholesale Terms.

7. Wholesale customers

Orders from retailers and distributors are governed by our Wholesale Terms, which form part of these Terms.

8. Acceptable use

You agree not to:

• give false information, including about your age or license status;
• buy for, give to, or resell to anyone under 21 or anyone legally prohibited from buying nicotine;
• interfere with, scrape, reverse-engineer or try to gain unauthorized access to the Services;
• use the Services for any unlawful purpose.

9. Intellectual property

SENO, the SENO logo, product names, packaging, images and all site content are owned by or licensed to Biostrips Corporation and protected by intellectual property laws. You may not copy, modify or use them without our written permission.

10. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Some states don't allow certain warranty exclusions, so some of these may not apply to you.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BIOSTRIPS CORPORATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR $100. These limits don't apply where the law doesn't allow them, including for liability that can't be limited for death or personal injury caused by negligence.

12. Indemnification

You agree to defend, indemnify and hold harmless Biostrips Corporation and its officers, directors, employees and agents from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, false information you give us, or any sale or supply of SENO products by you to anyone else.

13. Dispute resolution, arbitration and class-action waiver

• Informal resolution first: before filing any claim, you agree to contact us at [email protected] and try to resolve it informally for at least 30 days.
• Binding arbitration: any dispute that isn't resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat is Hamilton County, Ohio, or the arbitration can be held remotely. Judgment on the award may be entered in any court with jurisdiction.
• Exceptions: either party may bring an individual claim in small-claims court, or seek injunctive relief for infringement of intellectual property.
• Class-action waiver: claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims or award class-wide relief.
• Jury trial waiver: to the extent any claim proceeds in court, both parties waive the right to a jury trial.
• Opting out: you may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms.

14. Governing law

These Terms are governed by the laws of the State of Ohio and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 13, the state and federal courts in Hamilton County, Ohio have exclusive jurisdiction.

15. California Proposition 65

WARNING: This product can expose you to chemicals including nicotine, which is known to the State of California to cause birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.

16. General

• Entire agreement: these Terms, our Privacy Policy, Refund Policy and Wholesale Terms are the entire agreement between us.
• Severability: if any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest stays in effect.
• No waiver: our failure to enforce a provision isn't a waiver of it.
• Assignment: you may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure: we're not liable for delays or failures caused by events beyond our reasonable control, including regulatory action, carrier delays or supply shortages.
• Changes: we may update these Terms by posting a new version here. Continued use after changes means you accept them.
